The head of state signed the law "On Ratification of the Agreement on Pension Provision of Workers of the Eurasian Economic Union Member States."
The Treaty on the Eurasian Economic Union of May 29, 2014 enshrined the norms that created conditions for the free movement of labor resources throughout the territory of the integration association and the comfortable implementation of labor activities.
Member States have different pension systems. For example, there is no funded system in the Republic of Belarus. The accumulation systems of Kazakhstan, Russia, Armenia are different. The entry into force of the Agreement will allow resolving problematic issues.

At the same time, with the adoption of the agreement, Kazakh carriers will be able to carry out river transportation not only within the Irtysh basin, but also with access to the Ob River.
At the same time, the issue of resuming bilateral traffic between the ports of Atyrau and the Volga ports of Astrakhan and Volgograd is being considered.

The purpose of the law is to provide legislative support for the activities of the national security bodies, as well as to increase the efficiency of the protection and security system of the state border of the Republic of Kazakhstan.
In particular, the law optimizes the management model of the Border Guard Service (with the transition from a three-tier management model to a two-tier one), and also makes it possible to promptly use aviation in protecting and guarding the state border. The withdrawal of aviation from the Border Guard Service is envisaged, giving it the status of a department of the National Security Committee (NSC).

The Senate of the Republic of Kazakhstan adopted amendments to the Tax Code, which will allow Kazakhstanis to use part of their pension savings without paying income tax at a time.
In case of early withdrawal of part of the funds in pension savings, 10% of them is withheld as a one-time tax. Senators find it difficult for citizens in the current period. President Kassym-Jomart Tokayev instructed to enable people to use part of their pension savings starting from 2021. According to the current tax legislation, incomes subject to individual income tax include payments made by a unified accumulative pension fund from pension savings of taxpayers formed from pension contributions (Article 326 of the Tax Code).

According to the law, property and land tax of individuals will be paid in a single payment. This will reduce the cost of filling out receipts and paying bank fees. The land tax will also be abolished for owners of apartment buildings.

The Resolution of the Board of the National Bank of the Republic of Kazakhstan dated October 27, 2020 established the minimum size of the authorized capital of a payment organization. The regulation comes into force on July 1, 2021.
Thus, the following minimum authorized capital for payment organizations has been established:
- 50 million tenge for the provision of payment services for accepting cash for making a payment without opening a bank account of the sender of the money;
- 30 million tenge for the provision of payment services for the sale (distribution) of electronic money and payment cards;
- 40 million tenge for the provision of payment services for receiving and processing payments made using electronic money;
- 30 million tenge for the provision of payment services for processing payments initiated by the client in electronic form and transferring the necessary information to the bank, an organization that carries out certain types of banking operations, to make a payment or transfer or accept money for these payments.

According to changes made to the resolution, all arrivals when crossing the border of the Republic of Kazakhstan must submit a certificate of a negative PCR test for COVID-19, from the date of issue of the result of which no more than 3 days have passed. An exception is introduced for children under the age of 5 years if there is a certificate from the accompanying person.

Arriving citizens of the Republic of Kazakhstan, in the absence of a certificate, are subject to isolation in a quarantine hospital for up to 3 days for laboratory examination for COVID-19 by PCR.

As a result of this agreement, the exchange of information will improve, the issue of returning persons to other countries will be resolved, the period of stay of foreigners in Kazakhstan will be determined and dual citizenship will not be allowed. Also, the agreement will provide an opportunity to receive personal information about citizens and exchange experience between the governments of the two countries. To date, the ministry has approved 23 international agreements, nine more are under preparation.

The Senate adopted in two readings the law on the protection of the state border of the Republic of Kazakhstan and national security. The bill introduces amendments and additions to Code 1 and 25 laws, providing for: the inclusion of the Academy of the National Security Committee and the Aviation Service in other troops and military formations; the possibility of transferring employees of national security agencies to the category of military personnel in cases and in the manner determined by the chairman of the committee; empowering the chairman of the committee with the right to assign units of the national security body to other troops and military formations.

In addition, state institutions of the Armed Forces, other troops and military formations, special state bodies will be given the right to transfer and redistribute any property within the state body. The military police will be empowered to coordinate the activities of national security agencies in the field of proceedings on cases of administrative offenses.

Deputies of the Mazhilis of the Parliament of the Republic of Kazakhstan approved in the first reading the draft law "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on the Recovery of Economic Growth", which provides for the use of part of pension savings for targeted needs.
According to the bill, from 2021, the following can exercise the right to withdraw pension money:
- working citizens, within the limits of the available amount of pension savings, exceeding the "threshold of sufficiency" at the appropriate age;
- persons who have entered into pension annuity agreements with insurance companies, providing them with lifelong annuity payments in an amount not lower than the minimum pension - within the amount of pension savings remaining in the UAPF;
- established pensioners (including pensioners from among the security forces) - within no more than 50% of the remaining amount of pension savings in the UAPF. Provided that the aggregate size of their pension provides replacement of lost income at a level that meets international standards.

The head of state signed the Law of the Republic of Kazakhstan "On Amendments and Additions to the Law of the Republic of Kazakhstan" On the Republican Budget for 2020 - 2022. According to the amendments and additions to the Rules, permits for attracting foreign labor are issued for a period of:
1) for the first category - on the basis of the employer's application for one, two or three years, with the right to extend the permit for one, two or three years;
2) for the second and third categories - for 12 months, with an extension for a period of 12 months, but no more than three times;
3) for the fourth category - for 12 months without the right to renew;
4) for seasonal foreign workers - up to 90, 180, 270, 365 calendar days, without the right to renew.

At the same time, the permit to attract foreign labor is not renewed in the following cases:
- exceeding the size of the allocated quota;
- non-compliance by the employer with the conditions regarding the ratio of local and foreign workers;
- failure to fulfill obligations to replace foreign labor in the fourth category;
- establishment of the fact that the employer attracted foreign workers without a permit, as well as the involvement of a foreign employee in a profession or specialty that does not correspond to the profession or specialty specified in the permit. In these cases, the permits are not renewed within 12 months from the date of establishing such a fact.

An obligation is introduced for persons who are candidates for a public office, or a position related to the performance of public or equivalent functions, to notify the management of the organization in writing about close relatives, spouses and (or) in-laws working in this organization. The Law "On Combating Corruption" and a number of other laws specify that persons authorized to perform state functions and persons equated to them not only cannot hold positions that are directly subordinate to positions held by close relatives, spouses or in-laws, but also cannot may be directly subordinate to close relatives, spouses or in-laws.

Changes have also been made to the rules for issuing invitations for the entry of foreigners into the Republic of Kazakhstan. Now, to receive state services "Acceptance and approval of invitations of host persons for issuing visas of the Republic of Kazakhstan", "Issuance, restoration or extension of visas to foreigners and stateless persons on the territory of the Republic of Kazakhstan for the right to leave the Republic of Kazakhstan and enter the Republic of Kazakhstan" and legal entities. At the same time, individuals are the recipients of the state service "Issuance, extension of visas for entry into the Republic of Kazakhstan and transit through the territory of the Republic of Kazakhstan".

In order to modernize and improve the efficiency of the public administration system, the President of the Republic of Kazakhstan signed a decree on education:
1) The Agency for Strategic Planning and Reforms of the Republic of Kazakhstan with the transfer of functions and powers of the Ministry of National Economy of the Republic of Kazakhstan to it in the areas of strategic planning and state statistical activity.

Tokayev signed a decree on the formation of the Ministry of Emergency Situations of the Republic of Kazakhstan with the transfer of functions and powers to it:
- the Ministry of Internal Affairs of the Republic of Kazakhstan in the field of prevention and elimination of natural and man-made emergencies, civil defense, fire safety, ensuring the functioning and further development of the state system for preventing and eliminating emergency situations, organizing the prevention and extinguishing of fires;

The list of basic requirements for the provision of public services, as well as other information, taking into account the specifics of its provision, is set out in the Standard of the public service "Registration of documents for leaving the Republic of Kazakhstan for permanent residence".

The development of a bill has begun, giving the prosecutor the obligation to agree on all key procedural decisions affecting the rights and freedoms of a citizen.

Without such agreement, any action will not have legal force. In cases of failure to appear at the court session of all persons participating in the civil case, or when the court session is held without examining new evidence, the issue of keeping the minutes of the court session is decided by the judge.

The President of Kazakhstan signed the Administrative Procedure Code. The document is aimed at improving the institution of administrative justice. The Code came into force in July 2021.

The Code simultaneously regulates two important legal institutions: administrative procedures and administrative proceedings.

Administrative procedures combine any activity of government agencies related to the implementation of citizens' rights. For example, this is obtaining a license, certificates of residence, paying taxes.

The Government of Kazakhstan, by its decree of August 25, 2020, made changes and additions to the Rules for the implementation of public procurement using a special procedure.

In particular, the document states that public procurement by the method of tender is carried out without posting on the web portal of public procurement and the Internet resource of customers a notice of public procurement by the method of tender, texts of tender documentation, signed protocols of opening envelopes with applications for participation in the tender, protocols on preliminary admission to participation in the tender, admission and results of public procurement by the method of tender, with the exception of the case established by clause 10-1 of these Rules.

International flights with foreign countries will be resumed on 17 August.

The decree of the chief state sanitary doctor of Kazakhstan dated August 15 determined the procedure for those arriving in Kazakhstan from abroad. Countries are divided into three categories.

The first includes: China, South Korea, Japan, Georgia, Thailand, Hungary, India, Germany, Czech Republic, Malaysia, UAE, Belarus, Turkey, Egypt, Ukraine, Netherlands, Russia. Those arriving from these countries will be subject to thermometry and questionnaires.

The second category includes: Poland, Uzbekistan, Tajikistan. Passengers from this category will be checked for temperature and questioned. In addition, in the presence of a PCR certificate of examination for COVID-19 with a negative result, from the moment of receipt of which no more than 5 days have passed while crossing the border of Kazakhstan (hereinafter referred to as the certificate), there will be no restrictions.

In the absence of a certificate, a laboratory examination for COVID-19 by the PCR method is required at the place of arrival (for foreign citizens), at the place of residence (for Kazakhstani people) within 48 hours from the date of arrival, with the delivery of a notification of its mandatory passage or home quarantine for 14 days.

The EAEU countries have agreed on systemic approaches to the introduction of product labeling, regardless of the type of product and the level of labeling implementation - for the entire Union, for several states or at the level of one state.

The Law of the Republic of Kazakhstan "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on the Improvement of Enforcement Proceedings and Criminal Legislation" came into force.
According to the introduced amendments, all arrests of other bailiffs will be canceled by the bailiff who was the last to sell the property.

The head of state signed the law "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Mortgage Loans in Foreign Currency, Improving Regulation of Payment Services Market Entities, Universal Declaration and Restoring Economic Growth."

The amendments provide for the possibility of using electronic wallets by individual entrepreneurs and legal entities for making settlements, which will give an additional impetus to the development and use of electronic money as a convenient and simple instrument for payment.
The draft law also contains provisions aimed at regulating the procedure for withdrawing cash from bank accounts by business entities.

To recover VAT overpayments, the taxpayer submits a claim for the return of the amount of excess VAT indicated in the VAT return for the tax period directly to the tax authorities or through the e-government portal.

At the same time, the requirement to return the amount of excess VAT is reflected in the initial, regular or liquidation VAT declarations. If the VAT payer has not indicated in the VAT declaration for the tax period the requirement to return the excess VAT, then this excess is offset against forthcoming VAT payments or is presented for refund within the limitation period established by Article 48 of the Tax Code of the Republic of Kazakhstan.

Amendments have been made to the resolution of the Government of the Republic of Kazakhstan dated March 30, 2020 No. 155 "On the temporary closure of automobile checkpoints on certain sections of the State Border of the Republic of Kazakhstan." Automobile checkpoints "Kolzhat", "Bakhty" and "Maikapchagai" are opening on the border with China.

The draft Rules for the provision and receipt of information on an employment agreements in a unified system of accounting for employment agreements has been posted for public discussion until 15.07.2020.

Since May 16, 2020 in subparagraph 27 of p.2 of article 23 of the Labor Code of the Republic of Kazakhstan, a new provision has been introduced that establishes the obligation of the employer to enter information on labor agreements concluded with employees in the unified system of accounting for labor agreements USALA.

Now the employer is obliged to make information in the USALA about the conclusion and termination of an employment contract with the employee, amendments and (or) amendments made to it containing the following information:
- details of the parties;
- work in a particular specialty, profession, qualification or position (labor function);
- place of work;
- term of the employment contract;
- date of commencement of work;
- date of conclusion and serial number.

If the employer has an information system for staffing, the employer sends the necessary information through integration with USALA. In the absence of an information system for staffing, information is sent through the state Internet resource Labor Exchange www.enbek.kz. All information must be signed by the electronic digital signature of the employer.

These innovations allow the employer to optimize personnel records management, to obtain reliable information on qualifications, information on the labor activity of applicants (with their prior consent) and employees.

The purpose of the adoption of the Administrative Procedural Code of the Republic of Kazakhstan is to establish effective mechanisms for protecting citizens' rights when considering disputes with authorities in a higher authority and court, as well as to consolidate a set of guarantees that will allow citizens to really participate in the process of making managerial decisions.

The main objective of the law accompanying the Code on amending legislation on administrative procedural legislation is to bring the norms of certain legislative acts of the Republic of Kazakhstan into line with the provisions of the draft Administrative Procedural Code of the Republic of Kazakhstan, and to eliminate legal gaps and conflicts that arise when it is adopted.

Kazakhstan is preparing a bill in which special attention will be paid to the employment of people with disabilities. According to the Minister of Labor and Social Protection of the Republic of Kazakhstan, it is planned to create an atlas of professions taking into account the organization of employment of disabled people.

The Committee on Finance and Budget at an expanded meeting considered the Draft Law of the Republic of Kazakhstan "Concerning the introduction of Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Issues of Auditing". One of the main innovations introduced in the bill is the creation of a new non-profit organization - a professional audit board.

The creation of such an organization is consistent with international practice, since it contributes to the growth of economic policy of the state by creating a structure of independent supervision of audit activities. The new Code proposes to leave in the Criminal code violation by the medical worker of the procedure for conducting clinical trials and the use of new methods and means of prevention, diagnosis, treatment and medical rehabilitation only if it entails serious consequences or is committed by an official. It is also proposed at the same time to transfer the same acts to the Administrative Code if they did not entail grave consequences and were not committed by an official.

In addition, a norm has been included which establishes that in order to initiate a criminal case for medical offenses, the relevant acts of inspections and audits conducted by an authorized state body must be attached to the application. Now there is no such rule, therefore, with any application for the actions of doctors, a criminal case is immediately launched, which necessarily entails the conduct of various examinations, interrogations of suspects and interviews of witnesses, seizure of materials and other investigative measures.

The chief state sanitary doctor of the Atyrau region Amantai Zhumagaliev decided to extend the quarantine restrictive measures in the city of Atyrau and the region until the epidemiological situation is completely stabilized.

As part of the optimization of the civil process, it is proposed to raise the threshold for cases of simplified production: for individuals from 200 (505,000 tenge) to 1 thousand (2,525,000 tenge) MCI, for legal entities - from 700 (1,767,500 tenge) to 2 thousand (5,050 000 tenge) MCI.

As part of the digitalization of legal proceedings, it is proposed to transfer cases of order and simplified proceedings into electronic format, considered without calling the parties.

The President of the Republic of Kazakhstan signed the Law of the Republic of Kazakhstan "On Amending and Adding to Some Legislative Acts of the Republic of Kazakhstan on Civil Liability in the Use of Atomic Energy".

Since 2025, environmental payments will increase for enterprises that will not implement the best available technologies. This mechanism will affect the country's largest enterprises, which emit 70 percent of all emissions. Those enterprises that introduce the best technology will be exempted from environmental charges, and increasing amounts of environmental fees will not apply to them.

The main goal of the draft Code is to secure guarantees and establish effective mechanisms for protecting citizens' rights when considering disputes with authorities in a higher authority and court.

The law provides for the establishment in the Labor Code of a rule on the right of an employee to decent working and living conditions, the inclusion in the administrative law of a basis for holding employers accountable for discrimination in the workplace.

In order to digitalize personnel records management, the employer provides for the transfer of information on the employee's labor activities stipulated by the labor contract to the Unified System of Accounting for Labor Contracts.

The law also provides for fixing requirements for employers, employees and the authorized labor body for the implementation and functioning of the OSH management system. In cases where several organizations simultaneously carry out various types of work, general coordination is envisaged for observance of labor protection requirements by the general contractor.

The bill aims to regulate labor relations, social partnerships, safety and labor protection. The bill provides for the establishment of duties and responsibilities of the employer to create decent working conditions for the employee; granting the right to part-time work to employees caring for a sick family member; preservation of citizens for the period of military service; creation of a unified database of labor contracts.

In the field of safety and labor protection, it is proposed to introduce a labor protection management system at the enterprise, which will be based on an assessment of occupational risks in the workplace.

The state commission on ensuring the state of emergency made a decision to resume flights from May 4, 2020 from Nur-Sultan and Almaty to Kyzylorda, Ust-Kamenogorsk, Semey and Petropavlovsk. Flights will be operated in conditions of increased sanitary safety measures.

Kassym-Zhomart Tokayev signed a Decree on the extension of the state of emergency in the country until May 11, 2020.

According to the information of the NAO "Social Health Insurance Fund", until October 1, 2020, small and medium-sized businesses are exempted from contributions and deductions for compulsory social health insurance.

The list of SMEs, which are exempt from CSHI, includes subjects of trade, transport and maintenance, education, medicine, tourism, hotel and restaurant business, entertainment, software, and fitness. These petrochemical products produced at the Atyrau Refinery have passed the international REACH certification and, thus, have obtained the right to export to the countries of the European Union (EU).

The complex for the production of aromatic hydrocarbons, built as part of modernization at the Atyrau Refinery, under the project can produce annually 133 thousand tons of benzene and 496 thousand tons of paraxylene.

The deputies approved the draft law "On ratification of the Agreement on the mechanism of traceability of goods imported into the customs territory of the Eurasian Economic Union of May 29, 2019".

The provisions of the agreement regulate the terms and procedure for creating a mechanism for the traceability of imported goods imported into the customs territory of the Eurasian Economic Union. The list of goods subject to tracking is approved by the Council of the Eurasian Economic Commission. The tracking period is five years. The agreement defines the requirements for the exchange of information on the tracking of goods between the member states of the Customs Union.
