The Ministry of Foreign Affairs has prepared a draft decree of the President of the Republic of Kazakhstan "On the Special Representative of the President of the Republic of Kazakhstan for International Cooperation". The main tasks of the special representative include:
• establishment of international relations in the political, economic, humanitarian and environmental spheres;
• ensuring the promotion of the main directions of the country's foreign policy and initiatives of the President of the Republic of Kazakhstan.
It is planned that the Special Representative will perform the following functions:
• makes proposals to the President of the Republic of Kazakhstan on the development of foreign policy and international cooperation, implementation of international initiatives of the President of the Republic of Kazakhstan;
• organizes and conducts, within its competence, negotiations with political and public figures of foreign countries and international organizations, with representatives of business circles of foreign countries, participates in the promotion of priority projects in trade, economic, investment, technological and other spheres.
• participates in the preparation of the draft Foreign Policy Concept of the Republic of Kazakhstan and its subsequent implementation;
• participates in the preparation of the draft annual Address of the head of state to the people of Kazakhstan in terms of foreign policy of the Republic of Kazakhstan.
The activities of the special representative will be financed from the budgetary funds allocated to the Administration of the President of the Republic of Kazakhstan.

Kazakhstan expressed readiness to chair the 12th WTO Ministerial Conference

Tax calculation simplified for Kazakhstan entrepreneurs
A new special retail tax regime has been introduced for entrepreneurs working in the sectors most affected by the pandemic. Now it is enough for them to pay CIT / IIT in the amount of 3% of the turnover. As noted in the State Revenue Committee, this measure is being introduced as part of the execution of the order of the head of state and is temporary - its effect will last until the end of 2022.
The regime is voluntary, it is provided for small and medium-sized businesses recognized as such in accordance with the Entrepreneurial Code of the Republic of Kazakhstan and carrying out one or more types of activities determined by the resolution of the Government of the Republic of Kazakhstan for the purpose of applying this regime. It is designed for 2 years, - explained in the committee. They noted that the object of taxation is income without taking into account expenses, determined in accordance with the generally established procedure. For the application of the regime, the tax rate is set at 3% of the taxable object.
The tax will come from individual entrepreneurs in the form of individual income tax (except for taxes withheld at the source of payment), similarly, from legal entities - in the form of corporate income tax. The tax period is a calendar quarter.
Currently, entrepreneurs can submit a notification in the form posted on the website of the State Revenue Committee, via the e-government web portal and by mail or directly on paper to the state revenue authorities at the taxpayer's location, the department said.

Parliament adopts amendments to the law on the diplomatic service
The deputies of the Mazhilis agreed with the amendments made by the Senate to the law on the diplomatic service of the Republic of Kazakhstan.

Iran prepares to join the Eurasian Economic Union

Airlines begin to introduce e-covid passports

It became easier to enter the customs register of intellectual property objects
Previously, copyright holders had to confirm the fact of movement of goods across the customs border of the EAEU in violation of intellectual property rights. Institute of Parliamentarism established in Kazakhstan

Can the death penalty be applied in Kazakhstan - explanation of the Constitutional Court
At the request of the President of the Republic of Kazakhstan, the Constitutional Council gave an official interpretation to the provisions of the Constitution of the Republic on the application of the death penalty.

Ships of the Caspian countries will be able to pass through the ports of Kazakhstan
The head of state, Kassym-Jomart Tokayev, signed a law "On Ratification of the Agreement on Shipping."
So, the agreement defines the period for consideration of the application for a transit passage - 10 days, the issuance of the permit will be carried out by the authorized body. Of all the countries participating in the agreement, only Russia has inland waterways, along which transit navigation is possible.
Currently, a permit for a transit passage is issued by the government of the Russian Federation, and it takes three to six months to obtain it. Also, within the framework of the law, the transfer of bilateral transportations to the notification procedure is provided.

Annually, by April 1, the authorized bodies will agree on preliminary lists of ships that will carry out bilateral transportation. If necessary, these lists can be corrected during the year. At the same time, with the adoption of the agreement, Kazakh carriers will be able to carry out river transportation not only within the Irtysh basin, but also with access to the Ob River.

Tokayev signed a law on additional powers of the national security bodies

Kazakhstanis will be able to withdraw pension savings from 2021

The rules for issuing permits to attract foreigners to work have changed

3) for the fourth category - for 12 months without the right to renew;

At the same time, the permit to attract foreign labor is not renewed in the following cases:
- exceeding the size of the allocated quota;
- non-compliance by the employer with the conditions regarding the ratio of local and foreign workers;
- failure to fulfill obligations to replace foreign labor in the fourth category;
- establishment of the fact that the employer attracted foreign workers without a permit, as well as the involvement of a foreign employee in a profession or specialty that does not correspond to the profession or specialty specified in the permit. Quality Control Committee in Kazakhstan was reorganized

Tengri Bank revoked its banking license

The authority to issue visas at international airports in Kazakhstan has been transferred to the Ministry of Internal Affairs of the Republic of Kazakhstan.
By a joint order of the Minister of Foreign Affairs of the Republic of Kazakhstan and the Minister of Internal Affairs of the Republic of Kazakhstan dated September 1, 2020, amendments and additions were made to the Rules for issuing invitations, coordinating invitations for the entry of foreigners and stateless persons into the Republic of Kazakhstan, issuing, canceling, restoring visas of the Republic of Kazakhstan, as well as extending and reduction of their validity period.
According to the Order, the authority to issue visas at international airports in Kazakhstan was transferred to the Ministry of Internal Affairs of the Republic of Kazakhstan.
Besides:
- the procedure for issuing an electronic visa is normatively fixed.
- the list of 109 countries has been expanded and approved, citizens of which can receive single-entry business, tourist and medical treatment visas in electronic format.
- the possibility of changing the categories of visas "B10" (private), "C3" (work) and "C9" (educational) to a visa of the category "C2" (family reunification) on the territory of Kazakhstan is provided;
- the restriction on the extension of a C7 visa to foreigners carrying out missionary activities in Kazakhstan has been canceled, subject to the written consent of the authorized body of the Republic of Kazakhstan in the field of religious activity (previously, this visa was allowed to be extended only once in the territory of the Republic of Kazakhstan).

Changes have also been made to the rules for issuing invitations for the entry of foreigners into the Republic of Kazakhstan. Tokayev signed a decree on the formation of two agencies

Investigators will coordinate decisions with the prosecutor
The development of a bill has begun, giving the prosecutor the obligation to agree on all key procedural decisions affecting the rights and freedoms of a citizen.

Kazakhstan will reduce the number of taxes and payments
The President of Kazakhstan, Kassym-Zhomart Tokayev, in his Address to the people, instructed government agencies to radically simplify the fulfillment of tax obligations and reduce the number of taxes and payments.

Changes were made to the Rules for the use of audio and video recording equipment in courts
The head of the Department for ensuring the activities of courts at the Supreme Court of the Republic of Kazakhstan, by his order dated August 25, 2020, amended the Rules for the technical use of audio and video recording tools that ensure recording of the course of the court session, storage and destruction of audio and video recordings, access to audio and video recordings.

The President of Kazakhstan signed the Administrative Procedure Code. The document is aimed at improving the institution of administrative justice. The Code came into force in July 2021.

Resumption of international flights
International flights with foreign countries will be resumed on 17 August.

The decree of the chief state sanitary doctor of Kazakhstan dated August 15 determined the procedure for those arriving in Kazakhstan from abroad. Countries are divided into three categories.

The first includes: China, South Korea, Japan, Georgia, Thailand, Hungary, India, Germany, Czech Republic, Malaysia, UAE, Belarus, Turkey, Egypt, Ukraine, Netherlands, Russia. Those arriving from these countries will be subject to thermometry and questionnaires.

The second category includes: Poland, Uzbekistan, Tajikistan. Passengers from this category will be checked for temperature and questioned. In addition, in the presence of a PCR certificate of examination for COVID-19 with a negative result, from the moment of receipt of which no more than 5 days have passed while crossing the border of Kazakhstan (hereinafter referred to as the certificate), there will be no restrictions.

In the absence of a certificate, a laboratory examination for COVID-19 by the PCR method is required at the place of arrival (for foreign citizens), at the place of residence (for Kazakhstani people) within 48 hours from the date of arrival, with the delivery of a notification of its mandatory passage or home quarantine for 14 days.

With the rest of the countries - the third category - regular flights are prohibited. Irregular (evacuation and charter) flights are possible. In this case, the requirements apply to arriving persons as for passengers from the second category of countries.

The procedure for removing the arrest from the sold property has changed

Unified system of accounting for labor agreements
The draft Rules for the provision and receipt of information on an employment agreements in a unified system of accounting for employment agreements has been posted for public discussion until 15.07.2020.

Since May 16, 2020 in subparagraph 27 of p.2 of article 23 of the Labor Code of the Republic of Kazakhstan, a new provision has been introduced that establishes the obligation of the employer to enter information on labor agreements concluded with employees in the unified system of accounting for labor agreements USALA.

Now the employer is obliged to make information in the USALA about the conclusion and termination of an employment contract with the employee, amendments and (or) amendments made to it containing the following information:
- details of the parties;
- work in a particular specialty, profession, qualification or position (labor function);
- place of work;
- term of the employment contract;
- date of commencement of work;
- date of conclusion and serial number.

If the employer has an information system for staffing, the employer sends the necessary information through integration with USALA. In the absence of an information system for staffing, information is sent through the state Internet resource Labor Exchange www.enbek.kz. All information must be signed by the electronic digital signature of the employer.
